NESTOPIA WORKMANSHIP WARRANTY

GENERAL INFORMATION:

This is the Nestopia Workmanship Warranty. This warranty covers the workmanship/ work done by the various contractors at the site of the Client. This Warranty shall ONLY cover the Client to whom turnkey projects (including the projects where only certain contractor based work) is being provided by Nestopia.

Nestopia’s repair of the defect SHALL BE THE SOLE EXCLUSIVE REMEDY available to the covered person or entity with respect to any defect. There shall be no refund by Nestopia. Further, Nestopia will not refund or pay any costs in connection with repairs made by anyone other than Nestopia.

Nestopia’s liability to the covered person or entity shall be subject to the following terms and conditions:

  1. The covered person/entity must provide proof that they are the covered person/entity;

  2. The covered person/entity must provide written notice to Nestopia within 7 days after discovery of any claimed defect covered by this warranty and before beginning any repair. The notice must describe the location and details of the defect and such information as is necessary for Nestopia to investigate the claim.

This Warranty is no way to be treated as a Guarantee, and the statements in this warranty constitute the only warranty extended by Nestopia for its workmanship. NO OTHER WARRANTY SHALL BE MADE BY OR ON BEHALF OF NESTOPIA.

Any repairs made by Nestopia pursuant to this warranty shall constitute a full settlement and release of all claims of any covered person/entity hereunder for damages or other relief and shall be a complete bar to any litigation filed subsequently to the covered person/entity’s acceptance of such an agreement.

Exclusions: This warranty does not cover damage or defects resulting from or in any way attributable to:

(a) neglect; (b) misuse; (c) abuse; (d) repair or alteration made by anyone other than Nestopia; (e) settlement or structural movement and/or movement of materials to which

installed products are attached; (f) damage from incorrect design of the structure (in cases where there has been no structural work done by Nestopia); (h) acts of God including, but not limited to, hurricanes, tornados, floods, earthquakes, severe weather or natural phenomena, (including, but not limited to, unusual climate conditions); (i) lack of proper maintenance; and (j) any cause other than workmanship defects attributable to Nestopia.

The following categories of the workmanship are covered under this Warranty. The terms of each of these categories shall be read in conjunction with the clauses of the General Information stated hereinabove:

  1. Painting:-

  2. The Painting work done in the Client’s premises shall be covered by a warranty of 7 (seven) days from the date of the handing over of the Premises of the Client. The warranty shall cover:

    1. At least a two-coat work.

    2. If paint failure appears due to contractor’s negligence (related to human error), Nestopia will supply labor and materials to correct the said condition.

  3. Limitations:

Nestopia’s responsibility is limited to correcting the condition as indicated by the Client. Deck floors are not covered. Recurring structural cracks and damage from naturally occurring temperature differences, dirt or grime is not covered under warranty. Paint and other materials selected are not covered by this warranty.

Please refer to the manufacturer’s warranty statement for details about any warranties that may apply to the materials used on your interior or exterior painting project.

  1. Flooring :-

  1. Ceramic Floor Installation Warranty

  1. Nestopia warranties the workmanship of Ceramic Floor / Dado installation for 180 days from the date of handover. All workmanship is guaranteed to be best quality as per market standards.

  2. Should any defects due to faulty workmanship become apparent, Nestopia will correct the problem free of charge.

Limitations:

  1. Product defects are covered by the manufacturer’s warranty. This warranty covers only the installation provided by us. This warranty does not cover damage caused by abuse, neglect, improper use, cleaning agents or by loose lay installation. Types of service provided will be at no extra charge under the terms of the warranty which includes the repair of under floor gap, removal of air bubbles and loose grout.

  2. This warranty does not apply to repair caused from abuse, floods, improper maintenance or foundation settling.

  3. Wooden(Hardwood) Floor Installation Warranty

  1. Nestopia warranties the workmanship of Hardwood Floor installation for 180 days after the date of handover. All workmanship is guaranteed to be best quality as per market standards.

  2. Should any defects due to faulty workmanship become apparent, Nestopia will correct the problem free of charge.

Limitations:

  1. Product defects are covered by the manufacturer’s warranty. This warranty covers only the installation provided by us.

  2. This warranty does not cover damage caused by abuse, neglect, improper use, cleaning agents or by loose lay installation. Types of service provide at no extra charge under the terms of the warranty include repair of seams with gap, repair of transitional moldings, removal of air bubbles and loose grout. This warranty does not apply for gouges scratched or damage caused by water, erosion, insects, pets, spiked heel shoes, neglect, misuse, insufficient protection, improper maintenance, not maintaining proper humidity conditions etc.

  3. This warranty does not include fading of the floors against fading due to sunlight. As time goes by natural exposure to sunlight will slightly change the color of any hardwood floor. Since hardwood is a natural product your hardwood floor will continue to shrink and expand and depending on the season, humidity and heating conditions. Even if your hardwood floor is properly installed, the strips may shrink a little depending on the time of year. Any small gaps that might occur between the strips are normal and not covered by this warranty.

  1. Carpet Installation Warranty

  1. Nestopia warranties the workmanship of carpet installation for 180 days after the date of handover. All workmanship is guaranteed to be best quality as per market standards.

  2. Should any defects due to faulty workmanship become apparent, we will correct the problem free of charge. Types of service provided at no extra charge under the terms of the warranty include rectification of gap, ravel, or fray, re-stretching of carpet, repair of transitional moldings.

Limitation:

Product defects are covered by the manufacturer’s warranty.

This warranty covers only the installation provided by us. This warranty does not cover damage caused by abuse, neglect, improper use, cleaning agents, flood or foundation settling.

  1. Carpentry Work:

  1. Though all carpentry works are being executed with the approved materials and under best supervision of team Nestopia, Nestopia backs any materials defects [Ply, Laminate , veneer, wood ( excluding natural wear and tear )] and warrantee the workmanship for 180 days upon job completion/ hand-over of the same .

Limitation:

This warranty does not covers Handles, Faucets ( including its accessories), Door Knobs, Latches, Hinges, Padlocks, springs, hydraulic equipment etc as they are already covered under manufacturer's warranty.

  1. Electrical Work

  1. Nestopia gives 100% warranty for 180 days, from the handover of the premises for the wiring, switch / sockets excluding the light fittings, ballasts and its associated accessories.
